Terms of Service

Please read these Terms of Service ("Terms") carefully before using Kuratd (the "App") operated by Indie Studio ("we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, or using Kuratd, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not use the App.

2. Description of Service

Kuratd is a podcast intelligence application that provides:

• Podcast feed monitoring and management
• Audio transcription (on-device and cloud-based)
• AI-powered summarization and brief generation
• Search and export functionality
• Weekly digest compilation

3. User Accounts

Some features of Kuratd may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use Kuratd to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Distribute malware or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the App
• Scrape or harvest data for commercial purposes
• Circumvent any usage limitations or access controls

5. Content and Intellectual Property

Your Content

You retain ownership of any content you create using Kuratd, including notes, exports, and customizations. By using the App, you grant us a limited license to process your content as necessary to provide the service.

Third-Party Content

Podcast content accessed through Kuratd belongs to its respective creators. Kuratd does not host podcast audio; we access publicly available RSS feeds. You are responsible for respecting the terms of use of podcast content you access.

Our Intellectual Property

The App, including its design, features, and code, is owned by Indie Studio and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written consent.

6. AI-Generated Content

Summaries and briefs generated by Kuratd are created using artificial intelligence. While we strive for accuracy:

• AI-generated content may contain errors or inaccuracies
• You should verify important information from original sources
• We are not responsible for decisions made based on AI-generated content

7. Subscription and Payments

If Kuratd offers premium features:

• Payments are processed through Apple's App Store
• Subscriptions automatically renew unless cancelled
• Refunds are handled according to Apple's refund policies
• Prices may change with reasonable notice

8. Privacy

Your use of Kuratd is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Accuracy or reliability of transcriptions or summaries
• Uninterrupted or error-free operation
• Security of data transmission

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INDIE STUDIO SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of data, revenue, or profits
• Damages exceeding the amount paid for the App in the past 12 months

11. Indemnification

You agree to indemnify and hold harmless Indie Studio from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or by email. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your access to the App at any time, with or without cause. Upon termination:

• Your right to use the App ceases immediately
• You may export your data before termination takes effect
• Provisions that should survive termination will remain in effect

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If resolution is not reached within 30 days, disputes may be submitted to binding arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Indie Studio regarding the use of Kuratd.
